Problématique : Is it truly effective to restrict individuals' freedom in order to ensure
security, using the example of the TikTok ban in the unites states.
Intro:
On the 13 of march A law text has been voted by a large majority of the member of
the house of representatives to potentially ban TikTok from all the Appstore in the us.
This law would give 9 months to byte Dance to either sell its app or to see it being
ban from all the Appstore and all devices in the us.
But in order to see this happen the legislation to ban TikTok had to be voted in
majority by the us senate then signed by the president.
On 24 April, the US Senate passed legislation to ban TikTok.
Then few hours later President Biden signed this document.
The us government has decided to ban TikTok because it has been accused of
spying, propaganda and transferring data and personal information to the Chinese
government since it is a Chinese company.
But these recent actions taken have raised critical questions about the balance
between protecting citizens and preserving their liberties, particularly in a country in
which its first amendment of the constitution declare protecting freedom of speech
and individuals' liberties.
I will see here if it is effective to restrict individuals’ freedom in order to ensure
security, using the example of TikTok ban in the us:
I- National security and data privacy, propaganda, misinformation
TikTok is an application on which you can post or watch short and advertising
films from 3 seconds to 2 minutes.
It already had an issue about the fact that this concept of videos had created a
huge attach and addiction for the teenagers but also children that are more
and more present on the app.
But this time the app is accused by the us
authorities of spying and using its users’ data.
With about 170 million
American users this app may be a threat for the country.
So, the central explanation for banning TikTok is the protection of national security.
Us officials have expressed concern that TikTok collects vast amounts of data from
its users, including location data, browsing history and biometric information.
Indeed, an investigation by the Wall Street Journal in January have been showing
data being unofficially shared between TikTok in the US and Byte Dance in China.
Given TikTok's parents company, Byte Dance, is based in China there are fears that
this data could be accessed by the Chinese government under Chinese security
laws.
Such access could be used for espionage which could create huge risk for US
citizens and national interests.
These data could be an advantage for China against the us.
Indeed, as we know
these two countries have complicated relations and huge rivalries particularly in an
economic and political competition since they are the two largest world's economies
and try to dominate one another in new technology for instance.
But another concern about TikTok is that it could be used as a tool for propaganda
and influence operations.
Critics argue that the app may be giving false or biased
information favoring the Chinese government once again.
It might influence public
opinion that may interfere in democratic processes or even elections that are coming
soon.
"If TikTok continues to establish itself as the dominant news platform in America and if
the algorithm remains a black box and subject to the control of Byte Dance and, by
extension, the Chinese Communist Party, you're placing the control of information in the
hands of America's foremost adversary," Gallagher recently told the New....
